"PRO ARTIST PROGRAM"

1. PREAMBLE

1.1 The "PRO ARTIST Program" is offered by BIL BEAUTY IS LIFE GmbH, represented by the Chief Executive Officer Pascal Schnitzer, Dreischeibenhaus 1, 40211 Düsseldorf, Germany (hereinafter referred to as "BEAUTY IS LIFE").

1.2 By enrolling for the PRO ARTIST program, you accept these Terms & Conditions.

1.3 Registration and participation in the PRO ARTIST program are voluntary and free of charge.

2. PARTICIPATION REQUIREMENTS AND REGISTRATION

2.1 To participate in the PRO ARTIST Program, you must be 18 years of age or older, a resident of the United States of America, and have proven your eligibility in accordance with Section 2.3.

2.2 The following professional groups are eligible to participate:

• Makeup artists
• Hairdressers
• Beauticians
• Cosmeticians
• Cosmetologists

- (hereinafter referred to as "Professionals") -

• Students at schools that train one of the above-mentioned professional groups

- (hereinafter referred to as "students") -

2.3 Participation in the PRO ARTIST program requires:

2.3.1 For Professionals:

• The creation of a user account at www.beautyislife.com and the complete and truthful submission of the registration form.
• Providing proof of your activity as an active professional through one of the options below. The proof provided must clearly indicate your name and professional title.
  • Certificate/diploma/proof of completed training (at least 90 hours of training).
  • Professional license
  • Agency sedcard
  • URL of your professional website
  • Proof of representation by an association/agency
  • Employment certificate/employment contract

2.3.2 For students:

• The creation of a user account at www.beautyislife.com and the complete and truthful submission of the registration form.
• Providing proof of your status as a student through one of the options below. The proof provided must clearly indicate your name and course of education.
  • School certificate on letterhead of the school
  • Student ID card of the educational institution
  • Letter of admission from an accredited school (not older than 12 months)
  • Proof of payment for course/training/education

2.4 We will verify your eligibility for the PRO ARTIST program based on the information you have provided and the documents you have submitted. We will inform you by email about the result of the verification process. The decision on eligibility is solely at the discretion of BEAUTY IS LIFE.

2.5 Membership in the PRO ARTIST program is non-transferable. BEAUTY IS LIFE reserves the right to check your eligibility at any time.

2.6 In the event of any changes in your professional status, in particular if the requirements under section 2.2 are no longer applicable, you must notify BEAUTY IS LIFE immediately. We reserve the right to terminate your membership in the PRO ARTIST program.

3. DISCOUNTED PURCHASES

3.1 As an approved member of the PRO ARTIST program, you will receive a discount on our products. The products to which the discount applies are marked "PRO ARTIST" after you log in to your user account.

3.2 No discount will be granted on products that have already been reduced. A combination of the discount with other discount promotions, vouchers or offers is excluded.

3.3 Cash payout of the discount is not possible. The discounts may not be shared with third parties.

3.4 The discounted products may be purchased exclusively for professional use. Resale is only permitted after consultation with BEAUTY IS LIFE. If you are a business partner with your own business and wish to sell our products, please contact us.

4. CANCELLATION OF MEMBERSHIP

The termination of the membership is possible for both the member in the PRO ARTIST program and BEAUTY IS LIFE at any time without giving reasons and without observing a certain period of notice. Termination of membership without notice shall be effected in the event of infringement or serious infringement of these Terms and Conditions.

5. CHANGES TO THE TERMS & CONDITIONS

BEAUTY IS LIFE reserves the right to make changes or additions to the Terms & Conditions or discounts for the PRO ARTIST program at any time, provided that this appears necessary and the member is not disadvantaged thereby contrary to good faith. There will be no separate notification of this.

6. PRIVACY POLICY

We collect, store and process personal data from you for the purpose of operating and managing the PRO ARTIST program. For a detailed description of the use of your personal data, please refer to the privacy policy at https://www.beautyislife.com/us-en/Privacy/, which you accept as part of your registration for the PRO ARTIST program.

7. MISCELLANEOUS

7.1 Should individual provisions of this contract be invalid or unenforceable, or should they become invalid or unenforceable after conclusion of the contract, the validity of the rest of the contract shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision, the effects of which come as close as possible to the commercial objective which the parties to the contract pursued with the invalid or unenforceable provision. The above provisions shall apply accordingly in the event that the contract proves to be incomplete.
